2023 has already gone down as the year of the most regulatory changes for Class B home care companies since regulations were introduced back in 2010. On top of a pandemic, agencies in Colorado are reeling from a release by CDPHE of updated regulations after a total rewrite of Chapter 26., as well as additions and revisions to Chapter 2. Let’s do a quick recap of the evolution of regulations for home care agencies in Colorado. Back in 2009, when the iPhone 3 was released and the world was dealing a global pandemic called the “swine flu”, the Colorado Department of Public Health and Environment developed a set of rules for skilled home health and non-medical home care companies in Colorado. Prior to that time, there were no state level regulations. Home health regulations went into effect in 2009 and then non-medical home care regulations in 2010. 

 

As part of the rulemaking process CDPHE put a sunset provision so that every 10 years the regulations needed to be reviewed, revised with input from home care agencies and updated. Well, that was supposed to be accomplished back in 2020 and we all know what happened that year. Finally in 2021, the review process heated up and CDPHE hosted (virtually of course) meetings for months discussing all parts of Chapter 26. There were a lot of participating home care companies with A LOT of a feedback during the process. 

 

You may not have heard a lot about the Chapter 26 meetings and revisions as during this same time Chapter 2 was being heavily discussed. The topic on the table for Chapter 2 was regulations about mandatory COVID-19 vaccination for health care employees, as well as requiring reporting of staff vaccinations to CDPHE ongoing. 

 

Proposed changes for both Chapter 2 and 26 were presented to the Board of Health meeting on December 15, 2021. The Board of Health approved the changes at that meeting. After that meeting the regulations were finalized and then released online to all agencies on February 14, 2022. Happy Valentine’s Day!!

 

Ok, enough of the history lesson. The regulations changed we get it! So, what are the changes? There were significant changes in Chapter 26. Overall it increased from 57 to 60 pages, even after deleting a whole section that discussed how agencies were to transition to licensure back in 2009/2010.  

 

Top 5 regulatory in Chapter 26 for Class B agencies: 

  • Chapter 26 overall was shortened from 8 parts to 7 parts, deleting Part 2 which discussed what happened to new and existing agencies at the time of licensure back in 2009/2010.
  • Entire Part 7 (previously Part 8) for Non-Medical agencies was reorganized and updated, including: more flexibility for Governing Body/Administration/Agency Manager, PCW training requirements were restructured to create a stacked "homemaker" based qualification and then a "personal care worker" needing additional requirements, and telehealth visits for supervision being possible in certain circumstances.
  • Requirements around developing an Emergency Preparedness Plan in Part 5 were beefed up to include: adding a risk assessment component, modernizing outdated language, bolster existing requirements to ensure consumer and staff safety.
  • Duplicative references to Chapter 2 regulations were deleted or reduced. Regulations for home care agencies are more built in to Chapter 26 to stand independent of other chapters.
  • Part 7 for Skilled Home Health agencies was moved to Part 6 and this section had some large changes, including: deleting the requirement for a Professional Advisory Committee, written summary report for Plan of Care was reduced from every 60 days to only with a 'change in status', added telehealth visits are ok for nurse aide supervision in certain circumstances, and a new section about standards for clinical records. 

 

Also, the highlights for Chapter 2 updates include:

  • Part 12 was added for all health care entities requiring COVID-19 vaccination for all employees, direct contractors and support staff. (Then Part 12 was deleted in 2022 and CDPHE no longer mandated vaccination)
  • Policies must be developed for how to handle things like COVID vaccination, additional precautions for unvaccinated staff, etc.
